What are the chances that an investor owns 49% of a company but does not have rights to its IP? Especially when that investor is Microsoft?

Very reasonable? Microsoft doesn't control any part of the company and faces a high degree of regulatory scrutiny.

Isn't the situation that the company Microsoft has a stake in doesn't even own the IP? As I understand it, the non-profit owns the IP.
